Pace Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Pace: Running Pace Calculator mobile application (“App”) developed by Skipjack Studios (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Definitions
- “App” means the Pace: Running Pace Calculator iOS application, including all related services and content.
- “User” or “You” means any individual or entity accessing or using the App.
- “Service” refers to the App and any associated features or updates.
2. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use on compatible Apple devices, subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of the App. All rights not expressly granted are reserved by us.
3. Prohibited Conduct
You agree not to:
- Reverse engineer, decompile, or disassemble the App.
- Use the App for any unlawful purpose or in violation of any applicable laws.
- Transmit viruses, malware, or harmful code.
- Attempt to gain unauthorized access to the App or its systems.
- Use the App in a way that interferes with other users’ experience.
4. User Accounts and Content
The App does not require user accounts. Any data you input (e.g., pace calculations) is processed locally on your device and is not stored or transmitted by us. You are responsible for all activity under your use of the App.
5. In-App Purchases
The App is free to download and use. Optional in-app purchases may be available through the Apple App Store. All purchases are governed by Apple’s terms and refund policies. We do not process payments directly.
6. Intellectual Property
The App, including its design, code, and branding, is owned by Skipjack Studios or its licensors. You may not use our trademarks, logos, or intellectual property without written permission.
7. Third-Party Services
The App integrates with Apple services (e.g., Apple Watch, iOS features). Your use of these is subject to Apple’s terms. We are not responsible for third-party services.
8. Updates and Modifications
We may update the App at any time. Continued use after updates constitutes acceptance of changes. We reserve the right to modify, suspend, or discontinue the App at our discretion.
9. Disclaimer of Warranties
The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. Pace calculations are for informational purposes only and not professional advice. We do not guarantee accuracy or reliability.
10. Limitation of Liability
To the fullest extent permitted by law, Skipjack Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if advised of the possibility. Our total liability shall not exceed $100.
11. Termination
We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms.
13. Changes to Terms
We may update these Terms at any time. Changes will be posted in the App or on our website. Your continued use constitutes acceptance.
